1. Definitions
For the purpose of these Terms and Conditions:
- "Company," "We," "Us," "Our" refers to 72 Holidays
- "Client," "You," "Your" refers to the person(s) making the booking
- "Services" refers to travel packages, tour arrangements, and related services offered by 72 Holidays
- "Booking" refers to any reservation made through our website, email, phone, or in person
- "Tour Package" refers to the travel itinerary, accommodations, and services included in your booking
- "Third-Party Suppliers" refers to hotels, airlines, transport providers, activity operators, and other service providers
2. Acceptance of Terms
By using our website or services, you agree to:
- Be bound by these Terms and Conditions
- Comply with all applicable laws and regulations
- Provide accurate and complete information during booking
- Be financially responsible for all bookings made under your name
- Accept our Privacy Policy and Cancellation & Refunds Policy
Note: If you do not agree with any part of these terms, please do not use our services or make any bookings.
3. Booking & Reservations
3.1 How to Book

3.2 Booking Confirmation
- All bookings are subject to availability and confirmation
- A booking is only confirmed upon receipt of the required advance payment
- You will receive a booking confirmation via email within 24-48 hours
- Please verify all details in the confirmation and report any errors immediately
- Booking confirmation includes: tour details, payment schedule, terms, and itinerary
3.3 Minimum Age Requirement
- The person making the booking must be at least 18 years old
- Bookings for minors must be made by a parent or legal guardian
- Valid identification may be required at the time of booking
3.4 Group Bookings
- Special terms and discounts apply for groups of 10 or more persons
- Group leader is responsible for all members of the group
- Group bookings require detailed passenger lists at least 15 days before departure
- Custom itineraries can be created for group travel
4. Payment Terms
4.1 Payment Schedule
- Advance Payment: 50% of the total tour cost must be paid to confirm booking
- Balance Payment: Remaining 50% must be paid at least 15 days before departure
- Last-Minute Bookings: Full payment required for bookings made less than 15 days before departure
4.2 Payment Methods
We accept payments through:
- Credit/Debit Cards (Visa, Mastercard, RuPay)
- Net Banking (all major banks)
- UPI (Google Pay, PhonePe, Paytm, etc.)
- Bank Transfer (NEFT/RTGS/IMPS)
- Cash payments at our office (subject to availability)
4.3 Payment Security
- All online transactions are processed through secure payment gateways
- We do not store your complete card details on our servers
- Payment gateway charges (2-3%) are borne by the customer
- GST and other applicable taxes are included in the quoted price unless stated otherwise
4.4 Currency
- All prices are quoted in Indian Rupees (INR) unless specified otherwise
- International payments may be subject to currency conversion charges
- Prices are subject to change without prior notice until booking is confirmed
Important: Failure to make balance payment 15 days before departure may result in automatic cancellation of your booking and forfeiture of the advance payment.
5. Tour Inclusions & Exclusions
5.1 Standard Inclusions
Unless otherwise stated, tour packages typically include:
- Accommodation as per the itinerary (hotels/guesthouses)
- Meals as specified in the package (breakfast, lunch, dinner)
- Transportation as per the itinerary (private vehicle/shared cab)
- Sightseeing and activities mentioned in the package
- Services of a local guide (where applicable)
- All applicable taxes and service charges
5.2 Standard Exclusions
Unless otherwise stated, tour packages typically DO NOT include:
- Airfare or train tickets to/from the destination
- Travel insurance (highly recommended)
- Personal expenses (laundry, telephone, beverages, tips, etc.)
- Any meals not mentioned in the itinerary
- Entry fees to monuments, parks, or attractions (unless specified)
- Adventure activities not included in the package
- Camera fees at monuments or restricted areas
- Any expenses arising due to unforeseen circumstances (natural calamities, flight cancellations, etc.)
- GST on optional services availed during the tour

6. Travel Documents & Requirements
6.1 Passport & Visa
- Valid passport with minimum 6 months validity is required for international travel
- Visa arrangements are the sole responsibility of the traveler unless visa assistance is explicitly included
- Ensure you have the necessary permits for restricted areas (e.g., Inner Line Permit for certain regions)
- 72 Holidays is not responsible for visa rejections or entry denials
6.2 Identification Documents
All travelers must carry:
- Valid government-issued photo ID (Aadhaar, Passport, Driving License, Voter ID)
- Original copies (not photocopies) for verification
- Children must carry birth certificates or school ID cards
- Special permits for restricted areas must be carried at all times
6.3 Health Requirements
- Valid COVID-19 vaccination certificate (if required by destination)
- Any other health certificates required by specific destinations
- Carry prescription medications with doctor's prescription
- Inform us of any medical conditions or dietary restrictions in advance
7. Client Responsibilities
7.1 Pre-Tour Responsibilities
You are responsible for:
- Providing accurate information during booking (names, contact details, special requirements)
- Obtaining necessary travel documents (passport, visa, permits)
- Arranging travel insurance (highly recommended)
- Making timely payments as per the payment schedule
- Reading and understanding the tour itinerary thoroughly
- Informing us of any medical conditions, dietary restrictions, or special needs
- Arriving at departure points on time
7.2 During Tour Responsibilities
During the tour, you must:
- Follow the instructions of tour guides and 72 Holidays representatives
- Respect local customs, traditions, and laws
- Take care of your personal belongings
- Maintain appropriate behavior and not disturb other travelers
- Arrive on time for scheduled activities and departures
- Not engage in any illegal activities
- Respect the environment and practice responsible tourism
7.3 Code of Conduct
- Alcohol consumption in moderation and only where legally permitted
- No smoking in non-smoking areas or vehicles
- Respectful behavior towards fellow travelers, guides, and locals
- No harassment, discrimination, or offensive behavior
- Follow safety guidelines for adventure activities
Violation of Code of Conduct: 72 Holidays reserves the right to remove any traveler from the tour for misconduct, illegal activities, or behavior that endangers others. No refund will be provided in such cases.
8. Company Rights & Responsibilities
8.1 Our Responsibilities
72 Holidays is committed to:
- Providing services as described in your tour package
- Ensuring quality accommodations and transportation
- Providing experienced and knowledgeable guides
- Offering customer support before, during, and after the tour
- Maintaining transparency in pricing and terms
- Ensuring safety and security of travelers to the best of our ability
8.2 Right to Modify
72 Holidays reserves the right to:
- Make reasonable changes to the itinerary due to circumstances beyond our control
- Substitute hotels, vehicles, or services with equivalent alternatives
- Cancel or postpone tours due to insufficient bookings (minimum 4-6 persons required for group tours)
- Modify prices due to changes in taxes, fuel costs, or currency fluctuations (before booking confirmation)
- Refuse service to any person who violates our terms or endangers others
8.3 Substitutions
- If a hotel is unavailable, we will provide accommodation of similar or higher standard
- If activities are cancelled due to weather or other reasons, alternative activities may be provided
- You will be informed of any major changes as soon as possible
9. Liability & Limitations
9.1 Limitation of Liability
72 Holidays shall not be held liable for:
- Acts of God, natural disasters, pandemics, or force majeure events
- Political unrest, terrorism, civil disturbances, or war
- Flight delays, cancellations, or changes by airlines
- Loss, theft, or damage to personal belongings
- Personal injury, illness, or death during the tour (except due to our negligence)
- Services provided by third-party suppliers (hotels, airlines, restaurants)
- Delays or changes due to weather conditions
- Medical emergencies or pre-existing health conditions
- Any incident arising from failure to follow instructions or guidelines
9.2 Third-Party Services
- We act as intermediaries for hotels, transport providers, and other service providers
- These third parties operate independently and have their own terms and conditions
- We are not liable for the acts, errors, or omissions of third-party suppliers
- Complaints regarding third-party services should be addressed directly to the provider
9.3 Maximum Liability
In the event of any claim, our maximum liability is limited to the total amount paid by you for the tour package. We shall not be liable for any consequential, indirect, or incidental damages.
Travel Insurance Recommended: We strongly recommend purchasing comprehensive travel insurance to cover medical emergencies, trip cancellations, lost baggage, and other unforeseen events.
10. Force Majeure
72 Holidays shall not be held responsible for failure to perform any obligation under these terms if such failure is caused by:
- Natural disasters (earthquakes, floods, landslides, cyclones)
- Pandemics or epidemic diseases
- Government restrictions, lockdowns, or travel bans
- War, terrorism, or political unrest
- Strikes, labor disputes, or civil disturbances
- Extreme weather conditions making travel unsafe
- Any other circumstances beyond our reasonable control
In case of force majeure, we will make reasonable efforts to provide alternative arrangements or reschedule the tour.
11. Photography & Media Usage
11.1 Use of Images
- Photos and videos taken during tours may be used by 72 Holidays for marketing purposes
- By participating in our tours, you consent to the use of your images on our website, social media, and promotional materials
- If you do not wish to be photographed or have your images used, please inform us in writing
- We respect your privacy and will remove images upon request
11.2 Drone and Professional Photography
- Drone usage requires special permits and is subject to local regulations
- Commercial photography or videography requires prior approval
- Additional fees may apply for professional photo shoots during tours
12. Complaints & Grievances
12.1 During the Tour
- If you encounter any issues during the tour, immediately contact your tour guide or our customer support
- We will make every effort to resolve issues on the spot
- Document the issue with photos/videos if possible
12.2 Post-Tour Complaints
- Submit complaints in writing within 7 days of tour completion
- Include booking reference, detailed description, and supporting evidence

- We will investigate and respond within 10-15 business days
12.3 Compensation
- Compensation, if applicable, will be assessed on a case-by-case basis
- Claims must be reasonable and substantiated with evidence
- No compensation for minor inconveniences or subjective dissatisfaction

15. Governing Law & Jurisdiction
- These Terms and Conditions are governed by the laws of India
- Any disputes shall be subject to the exclusive jurisdiction of courts in Srinagar, Jammu & Kashmir
- Both parties agree to first attempt to resolve disputes through good faith negotiations
- If negotiations fail, disputes shall be resolved through arbitration or court proceedings
16. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that closely matches the intent of the original.
17. Amendments
- 72 Holidays reserves the right to modify these Terms and Conditions at any time

- The terms applicable at the time of your booking will govern your reservation

18. Entire Agreement
These Terms and Conditions, together with our Privacy Policy and Cancellation & Refunds Policy, constitute the entire agreement between you and 72 Holidays. They supersede all prior agreements, understandings, or communications (written or oral).
